The Law

Since April 2008, Landlords are required by law to protect your tenancy deposit with one of three government protection schemes within 30 days of you paying it. The three government deposit protection schemes are:

  1. The Deposit Protection Service
  2. The Tenancy Deposit Scheme,
  3. MyDeposits

Not only must your deposit be protected within 30 days, the landlord also has to give you information about how your deposit is protected and information about the scheme in addition to other information set out in law. This information is called the "Prescribed Information." Your landlord must also give you the Prescribed Information within 30 days of receiving your deposit in addition to protecting your deposit. 

What happens if my landlord has broken the law?

If your landlord has broken the law in not protecting your deposit or not giving you the Prescribed Information within 30 days of you paying your deposit, you can make a claim against your landlord for between 1 - 3 times your deposit per breach.
