Represent Law has obtained £7,155 for former tenants of a property in Pentonville at trial. Represent also secured the return of the tenants' deposit of £4,770 before trial.
The landlord and agent tried to argue that the tenants were not assured shorthold tenants but rather the rental was a 'holiday let' and therefore their deposit didn't need to be protected. Also, the agent didn't return the deposit until 3 months after the end of their tenancy. Their deposit was only returned after Represent Law sent the first letter before claim.
At trial the judge dismissed the agent's and landlord's argument that the claimants were not tenants ordered the landlord and agent to pay deposit protection penalties under s.214(4) of the Housing Act 2004 within 14 days.
